In the state of Washington, divorce is “no fault,” which means that the only legal ground for divorce is an “irretrievable breakdown” of the marriage. An irretrievable breakdown simply means that the couple’s marriage is permanently broken and cannot be repaired. Since Washington is a no-fault divorce state, it is unnecessary for both spouses to agree to a divorce. One spouse is free to file for divorce if he or she wants to do so.
Ultimately, under Washington law, one spouse can force a divorce without the other’s consent. So long as one spouse wishes to get divorced, the divorce will occur whether the other spouse agrees or not.
