Common Myths About Step-Parent Adoption

Myth: Marriage alone makes a step-parent a legal parent.

Marriage creates a family relationship, but it does not grant parental rights. A step-parent does not gain legal authority over a child simply by marrying the child’s parent. Without adoption, a step-parent generally cannot make independent medical, educational, or legal decisions for the child.

Myth: Step-parent adoption is automatic if the other parent is absent.

Even when a biological parent has been uninvolved for years, Washington law does not treat adoption as automatic. The absent parent’s rights must still be addressed through valid consent or formal termination. Courts require proof that legal notice and due process requirements have been met before allowing an adoption to proceed.

Myth: A step-parent automatically gains parental rights by raising the child.

Living with, supporting, or helping raise a child does not create legal parental rights. Without adoption, a step-parent has no independent authority to make decisions for the child if something happens to the biological parent.

Myth: Step-parent adoption eliminates child support automatically.

Child support obligations do not disappear simply because a step-parent adopts a child. While future support obligations may change, that happens only by court order. Importantly, unpaid child support or child support arrears do not go away simply because parental rights are terminated. Until the court enters orders addressing support, prior obligations generally remain enforceable.

What Is a Step-Parent Adoption in Washington State

What is a step-parent adoption?

A step-parent adoption is a legal process that allows a parent’s spouse to become the child’s legal parent. Once finalized, the adopting step-parent has the same legal rights and responsibilities as a biological parent. This includes decision-making authority, support obligations, and inheritance rights. Step-parent adoption permanently changes the child’s legal family structure.

Do I have to be married to adopt my stepchild?

Yes. Washington law requires a step-parent to be legally married to the child’s parent in order to pursue a step-parent adoption. Cohabitation alone does not qualify, even if the step-parent has been involved in the child’s life for many years. This requirement is statutory and strictly enforced. RCW 26.33.020

Can a step-parent adopt if the child lives with us full time?

Living with the child full time does not by itself create legal parental rights. Even when a step-parent has acted as a parent for years, adoption is still required to obtain legal authority. Courts rely on legal status, not caregiving history alone, when determining parental rights. Adoption is the only way for a step-parent to become a legal parent.

Can a step-parent adopt more than one child at the same time?

Yes. A step-parent may adopt multiple children in the same case if all legal requirements are met for each child. However, each child’s situation is evaluated independently, particularly with respect to consent and termination of parental rights. Additional children can increase complexity and cost.

Termination of Parental Rights in Step-Parent Adoption

Does the other biological parent have to consent to the adoption?

Not necessarily. In a step-parent adoption, the other biological parent’s rights must be relinquished voluntarily or terminated by court order before the adoption can proceed. If parental rights are relinquished or terminated, the parent’s consent to the adoption itself is no longer required because they are no longer a legal parent. What if the other parent refuses to consent?

If consent is refused, the court may still consider termination of parental rights if statutory grounds are met and termination is in the child’s best interests. These cases are considered contested and often take longer. Courts apply heightened scrutiny because termination permanently ends parental rights.

What if the other parent cannot be found?

If a parent cannot be located, the court may allow alternative service methods only after a documented diligent search. Adoption cannot proceed until service and notice requirements are satisfied. Improper service can invalidate later court orders.

What is relinquishment in a step-parent adoption?

Relinquishment is the voluntary termination of parental rights by a biological parent. Even when termination is voluntary, a court hearing is required and cannot occur sooner than 48 hours after the relinquishment is signed. A relinquishment may be withdrawn before or at the hearing approving it. RCW 26.33.090

Can termination affect child support obligations?

Termination of parental rights does not automatically eliminate unpaid child support. Child support arrears remain enforceable unless the court enters orders addressing them. Future support obligations may change only by court order.

Placement Reports and Background Checks

Are placement reports required in step-parent adoptions?

Yes. In a step-parent adoption, the court does not require a pre-placement report before the adoption can move forward, but it does require a post-placement report before the adoption can be finalized. This requirement applies to every adoption of a minor child in Washington, including step-parent adoptions. The post-placement report allows the court to confirm that the adoption is appropriate and consistent with the child’s welfare. RCW 26.33.220

Are background checks required for step-parent adoption?

Yes. Background checks are required in most step-parent adoptions to ensure eligibility and child safety. The scope of the check depends on the facts of the case and statutory requirements. RCW 26.33.190

Who prepares the placement report?

Placement reports are prepared by qualified professionals or agencies authorized under Washington law. These reports are intended to be neutral assessments rather than advocacy documents. Accuracy and completeness are critical.

Legal Rights and Obligations Before and After Adoption

What legal rights does a step-parent have before adoption?

Before adoption, a step-parent generally has no independent legal authority over the child. Any authority exercised is typically through the biological parent. If something happens to that parent, the step-parent may have no legal standing without adoption.

What changes legally after step-parent adoption is finalized?

After adoption, the step-parent becomes a full legal parent with the same rights and responsibilities as a biological parent. The child’s legal relationship with the terminated parent ends. These changes are permanent.

How does step-parent adoption affect inheritance?

After adoption, the child is treated as the legal child of the adoptive parent for inheritance purposes. The child generally no longer inherits from the terminated parent unless separate estate planning is done.
